By accessing or using the Winmark Member Portal (“Portal”), you agree to comply with and be bound by these Terms of Use. If you do not agree with these Terms, you must not access or use the Portal.
1. Purpose of the Portal
The Portal is designed to support peer-to-peer knowledge sharing, collaboration, and professional networking among individuals with authorised access (“Users”). It is provided exclusively for professional dialogue, the exchange of ideas, and the sharing of best practice. It must not be used for commercial or promotional purposes.
2. Prohibition on Sales and Marketing
Users must not use the Portal to:
Promote, market, or sell products or services (including consulting or advisory services);
Solicit business, investment, or funding from other Users; or
Send unsolicited commercial messages, advertising, or sales materials.
Any activity that Winmark reasonably deems to constitute a sales or marketing approach will be treated as a breach of these Terms.
3. Enforcement and Sanctions
If Winmark determines that a User has used the Portal for sales or marketing purposes, Winmark may, at its sole discretion:
Immediately suspend or restrict that User’s access to the Portal for any period deemed appropriate; and/or
Permanently remove access to the Portal.
Such actions may be taken without refund of any membership fees or other payments made to Winmark.
4. Duty to Report Misuse
Users are expected to uphold the integrity of the Portal community. If a User becomes aware of any activity that may breach these Terms—particularly sales or marketing activity—they should promptly notify Winmark at centraloperations@winmarkglobal.com. Reports will be treated confidentially.
5. Updates to Terms
Winmark reserves the right to amend these Terms of Use at any time. Any updates will be communicated via the Portal or by email, and continued use of the Portal will constitute acceptance of the revised Terms.
